I'm no lawyer either, but according to the wikipedia entry on mithril:
The name mithril or similarly spelled variations (mithral, mythril, and others) is present in other fictional contexts like role-playing games, video games and books since the Tolkien Estate did not trademark the term.

One thing to consider is that good modules don't need to be really long. The Giants modules were all about 16 pages each, if memory serves me correctly. The important thing is to set up an interesting situation and figure out a few key encounters. Most of the rest of the modules can be quite generi...
